This policy applies to all products, services and websites provided by AquaFold Inc. This policy does not apply to companies that AquaFold does not control or individuals that are not employed or managed by AquaFold.

Notice

When you register with AquaFold, use AquaFold products or services, AquaFold collects your personal information. Such information includes:

• Personally identifiable information - information that can be used to uniquely identify, contact, or locate a single person or can be used with other sources to uniquely identify a single individual. It includes but is not limited to name, home or business address, e-mail address, phone number.
• Some information entered by you in the process of enrollment to online services provided by AquaFold can be personally identifiable if you elect to use your name as a User Account username or upload your photograph as a User Account image. If you do not wish to provide personally identifiable information for enrollment to online services do not use your name as the username and do not upload your photograph.
• Username and user profile image used for the online services, including AquaClusters service are always associated with the content you create and share using AquaClusters sharing functions. Scope of sharing depends on your account settings. Some settings allow free sharing of your content, in which case it becomes accessible by any Internet user, indexed and listed by the search engines or third party web sites. If you do not want sharing of your username and user profile image use appropriate account settings that limit the scope of sharing.
• Default settings of AquaClusters do not allow user profile page that contains username, user profile image and list of projects associated with this account to be accessible from the Internet. It can be discovered and accessed by any logged-in AcuaClusters user only if the exact page URL knowingly or unknowingly is entered in the web browser.
• Demographic information – characteristics of a human population that cannot identify a single person but help to determine a subgroup of the population a person belongs to. Demographic information  includes but is not limited to age, gender, ZIP code,  education, profession, experience, interests.
• If you choose to subscribe for a paid service or make a purchase, AquaFold will collect payment specific information such as credit card or bank account number and billing address.

AquaFold through its applications automatically receives and records some information from your computer and web browser. Such information includes but is not limited to computer IP address, cookie information, and software and hardware attributes of your system.

AquaFold processes personally identifiable information solely for the purposes described in this Privacy Policy. Such purposes include:

1. Identification of users of AquaFold products and services;
2. Fulfillment of requested products or services;
3. Maintenance of functioning of AquaFold products and services;
4. Providing user support for AquaFold products and services;
5. Protecting rights and property of AquaFold and its users;
6. Communication with you regarding business of AquaFold or its partners;
7. Production of aggregated non-personal information - information that is recorded and collected into groups so that it no longer references a particular person;
8. Conducting audit and analysis for improvement of AquaFold products and services and development of new products and services;
9. Promotion of newly developed AquaFold products and services and improvements for existing products and services;
10. Providing you with customized content, products or services.

Choice

At the time of registration you can decline submitting personal information to AquaFold. However AquaFold may not be able to provide some or all of its products or services to you.

You can choose to prevent using your personal information for any purpose other than described in this Privacy Policy. For any offer that deals with use of your personal information other than for the purposes defined in this Privacy Policy, AquaFold will provide you a way to opt out of the other use.

AquaFold will not request or use sensitive information without your explicit consent.

You can choose to disable cookies in your browser. In such case AquaFold will not be able to collect personal information received by its applications from cookies. However some of the functionality of AquaFold services and products may be disabled. In case of disabling cookies in your browser you will not be able to access AquaClusters service.

If you close your AquaClusters account, AquaFold will remove your name and other personally identifiable information from our publicly viewable database. If you close your account, we have no obligation to retain your information, and may delete any or all of your account information without liability. However, we may retain certain data contributed by you if AquaFold believes it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law. AquaFold may also retain and use your information if necessary to provide the Services to other Users. Your contributions to AquaClusters Answers, Discussion Groups, Public Projects and other publicly accessible URLs may remain visible to others after you have closed your account. Similarly, other information you have shared with others, or that other Users have copied, may also remain visible. AquaFold shall not be liable for the deletion or retention (subject to the terms herein) of information or any obligation not to delete the information. AquaFold does not control when search engines update their cache, which may contain certain public profile information that has since been removed from AquaClusters publicly viewable database.

Onward Transfer

Transfers of your personal information from AquaFold to external individuals or non-affiliated business entities are limited to the following circumstances:

1. AquaFold has an explicit consent from you;
2. AquaFold is obliged to do so by applicable law;
3. AquaFold has to respond to court orders, subpoenas, or legal process, or to exercise its legal rights and defend against legal claims;
4. AquaFold in good faith believes that disclosure of personal information is necessary to prevent or take actions against illegal activities or harm to the rights or property of AquaFold and its users as it is permitted by law;

If AquaFold becomes involved in a process of merger, acquisition or sale of its assets, you will be notified before your personal information becomes subject to a different privacy policy.

AquaFold reserves rights to share aggregated non-personal information with external business entities or individuals. This information cannot be used to identify you.

Access

AquaFold provides access to your personal information collected at  registration and in the course of using AquaFold products and services. You may access and correct your personal information and privacy preferences by writing AquaFold at:

Personal information stored in the AquaClusters service systems can be accessed and changed by registered AquaClusters users online at https://www.aquaclusters.com/.

You can request AquaFold to change inaccurate data related to your personal information or to delete such data if it is not required to be retained by law or legitimate business purposes of AquaFold. AquaFold may decline such requests in case you fail to identify yourself, your requests have unreasonably recurrent nature, or your requests require disproportional technical efforts. Please be aware that even after your request for a change is processed, AquaFold may, for a time, retain residual information about you in its backup and/or archival copies of its database.

Security

AquaFold adopts best industry practices based on technology and corporate policies to protect personal data  against unauthorized disclosure, alteration or deletion. Security measures include:

1. AquaFold always offers password protected access to the user profile page.
2. Sensitive data (such as credit card information or passwords) is protected by SSL encryption when it is exchanged between your web browser and the AquaFold websites.
3. AquaFold stores personal information on computer systems with limited access, which are located in access controlled facilities.
4. AquaFold restricts access to personal information to only its employees and contractors who need this information in order to operate, support or develop products and services of AquaFold. All employees and contractors are bound to confidentiality and non-disclosure agreements with AquaFold prior to  receiving access to personal information.

Data Integrity

AquaFold collects and stores personal information relevant for the purposes it is used by its products and services.

AquaFold takes technical measures to prevent collected private information from corruption and loss due to the equipment malfunctioning and failure. Such measures include systematic back-ups of data collection, data restoration procedures, implementation of intentionally redundant computer and data storage systems.

Under terms of  the User Agreement AquaFold encourages users to cooperate towards keeping personal data accurate and current by providing accurate information, correcting or reporting inaccuracies whenever necessary.

In the event AquaFold receives a formal written notice at this address, AquaFold will contact the  complaining user regarding his or her concerns. If complaints cannot be resolved between AquaFold and the individual, AquaFold will cooperate with the regulatory authorities to resolve it.

In the event AquaFold becomes aware that user's personal information has been disclosed in violation of this Privacy Policy, AquaFold reserves rights to take measures, including but not limited to, investigation and reporting, and notification to and cooperation with law enforcement authorities. AquaFold will also take appropriate actions to notify the affected user of what information has been disclosed.

AquaFold reserves the right to update and change this Privacy Policy. If AquaFold makes such changes, a notice will be posted on the web page containing the Privacy Policy. Using the AquaFold Services and Websites after a notice of changes has been published on our site shall constitute consent to the changed terms of the Privacy Policy.
